Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or utilizing the electronic wallet, VTU vending tools, or agent services provided by NivoltPay Technologies Ltd ("NivoltPay", "we", "us", or "our"), you agree to be legally bound by these Terms of Service. If you do not accept these terms, you must discontinue platform use immediately.

2. Agent Registration & Account Security

• Eligibility: You must be at least 18 years old and legally competent to enter into contracts under Nigerian law.
• Accuracy of Information: You agree to provide true, accurate, and current information during registration and keep your profile credentials up to date.
• Account Credential Confidentiality: You are solely responsible for safeguarding your login password and transaction PIN. NivoltPay staff will never ask for your password or PIN under any circumstances. Any activity conducted under your authenticated credentials is your legal responsibility.

3. Electronic Wallet & Transaction Operations

• Prepaid Ledger: NivoltPay operates on a prepaid wallet model. Funds deposited into your active wallet represent digital store credits usable for purchasing telecommunication airtime, data bundles, electricity tokens, cable television subscriptions, and exam scratch cards.
• Funding Methods: Wallet top-ups are supported via automated bank transfers to dedicated virtual accounts (assigned via partner banks) and online debit card checkout processed securely through Paystack.
• Reversals & Refunds: In the event that a service provider fails to deliver a vending order, the debited amount is subject to automated reversal in accordance with our published Reversal & Refund Policy.

4. Agent Commissions & Reseller Rates

Agents and sub-agents earn discount commissions as outlined in our active pricing schedules. NivoltPay reserves the right to adjust wholesale telecom rate cards based on direct tariff alterations mandated by upstream telecommunication operators or regulatory directives from the Nigerian Communications Commission (NCC).

5. Prohibited Activities

You strictly agree not to:

• Use the NivoltPay platform or services to facilitate fraud, identity theft, money laundering, or unauthorized card testing.
• Attempt to reverse-engineer, decompile, scrape, or exploit vulnerabilities in our application interfaces.
• Circumvent or tamper with identity verification processes or KYC limits.
• Engage in abusive chargebacks after valid service delivery.

6. Suspension & Account Termination

We reserve the right to suspend, freeze, or terminate your access to the platform and report relevant details to law enforcement authorities (including the EFCC or Nigerian Police Force) if suspicious, illicit, or fraudulent activity is detected on your wallet account.

7. Limitation of Liability

NivoltPay provides its digital infrastructure on an "as-is" and "as-available" basis. While we maintain a 99.9% uptime target, we shall not be held liable for indirect, incidental, or consequential damages resulting from upstream carrier network blackouts, disco grid downtime, or third-party banking network delays outside our direct control.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of these terms shall be settled through amicable mediation, or referred to the competent courts of Lagos State, Nigeria.
